Gerald Vontsteen appeals his sentence, claiming a due process violation under North Carolina v. Pearce, 395 U.S. 711, 89 S. Ct. 2072, 23 L. Ed. 2d 656 (1969). A panel of this court gave plenary review to Vontsteens claims and affirmed the sentence. Upon rehearing en banc, we, too, affirm Vontsteens sentence, but hold only that the district courts sentence did not amount to plain error.
