Appellant Porfirio Valencia appeals his conviction for possession of cocaine with intent to distribute, in violation of 21 U.S.C. Â§ 841 and 21 U.S.C. Â§ 846. Valencia challenges his conviction on the grounds that the governments failure to disclose material exculpatory evidence impeaching a government informant violated his Fifth Amendment right to due process and his Sixth Amendment right to confront and cross-examine witnesses. We affirm the conviction.
